JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Petitioner is in jail custody since 16.02.2019 on the accusation that near about 18 liter country made liquor, kept in 62 bottles, were recovered from her conscious possession. Para 3 of the petition goes to show that petitioner does not have any criminal antecedent and furthermore, petitioner happens to be a woman.

Regard being had to the aforesaid facts and

No.24648 of 2019(2) dt.18-04-2019 2/2 circumstances as well as submissions of the parties and also taking note of her period of detention in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Chhauradano P. S. Case No. 48 of 2019.
