====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Ram Prawesh Kumar, learned counsel for the petitioner and Sri Harendra Prasad, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Koransarai P.S. Case No.10/2017 registered for the offence under Section 30(a), 47of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that it is true that the petitioner is doing job of driving, but the vehicle from which recovery of Indian Make Foreign liquor was shown, he was not the driver of the said vehicle. It was alleged that after noticing the police, the petitioner had fled away. He submits that nothing was recovered from the conscious possession of the petitioner and he has been made

Patna High Court Cr.Misc. No.46546 of 2017(2) dt.17-10-2017 2/2 accused in the present case only on suspicion. Learned counsel for the petitioner has also drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent.

Considering the fact that the petitioner's name has come only on suspicion and nothing was recovered from his conscious possession as well as clean antecedent of the petitioner, let the petitioner, namely, Vikki Bari @Satyendra Bari, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge-II-cum- Special Judge, Excise Act, Buxar, in connection with Koransarai P.S. Case No.10/2017 subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) nawalkrs/- U T
