2. The petitioner is apprehending her arrest in connection with Ghosi P.S. Case No. 242 of 2023 for the offence under sections 341, 323, 498(A) and 306/34 of the I.P.C. lodged on 13.04.2023 by the informant, Ramji Prasad.
3. As per the prosecution story, the informant alleged that the marriage of the daughter, Khusbu Kumari was solemnized with Raj Kumar Yadav and they are blessed with two children. On 11.04.2023, came to know about the torture of the victim and later, it was informed that she is being taken for treatment. In between, the allegation is that fed up with their attitude, the victim jumped in the Ganga River near Fatuhan. This led to the FIR.
4. Learned counsel for the petitioner submits that she
2/4 is mother-in-law, pursuant to the partition between the two sons namely Raj Kumar Yadav and Raju Kumar, the parents decided to live with the younger son, Raju Kumar and the partition document attached is of the year 2019 marked as Annexure-P/2 to the petition. The further submission is that the husband has been granted bail by the Sessions Court on 29.10.2024, this lady has no criminal antecedent and shall abide by the terms and conditions.
5. Learned APP opposes the prayer submitting that though charge-sheet has been submitted under Section 306 of the I.P.C., the torture led her to jump in the river Ganga and the body could not be traced out.

Having heard the parties, it is unfortunate that a young person left this world, the record shows that the lady is separated from the elder son, Raj Kumar Yadav since the year 2019, charge-sheet has been submitted under Section 306 of the IPC, in that background, this Court is inclined to extend her the privilege of anticipatory bail with conditions.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the
3/4 satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Ghosi P.S. Case No. 242 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of her bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of her bail bonds.
8. Having recorded the order, this Court directs the S.P. Jehanabad to direct the S.H.O. Ghoshi Police Station to take information from all the connecting Police Stations about the recovery of any body from the River Ganga on the day, the lady alleged to have jumped in the river (12.04.2023) and they are
4/4 duty bound to incorporate the findings pursuant to the said inquiry.
9. List this case on 31.10.2025 under the heading 'To be Mentioned' when a report of the S.P., Jehanabad shall be part of the record.
10. Mr. Jitendra Kumar Singh, learned APP shall ensure that the report of the S.P., Jehanabad comes regarding the said inquiry.
11. Let the name of Mr. Jitendra Kumar Singh, learned APP appear in the cause list.
