The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

As per prosecution case the informant's son-in-law Manoj Das used to drive auto of one Vikash Choubey and he had parked auto in the bus stand and was taking rest in the night, but unknown accused stabbed knife on the chest and abdomen of his son-in-law due to which he died It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.36714 of 2021(3) dt.07-04-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.

From perusal of the case diary of para no.8, it appears that the petitioner caught hold of the deceased and other coaccused Chhotu Khan @ Kalia stabbed the deceased due to which, he was succumbed to injury and the postmortem report also shows that the cause of death was sharp pointed weapon, as such, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.
