JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2017 Petitioner is apprehending his arrest in connection with Barauni (Refinery) P.S. Case No. 320 of 2015, a case registered for offences punishable under Sections 498(A), 307, 323 and 34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. It has been submitted on behalf of the petitioner that petitioner is the husband of the deceased and has falsely been implicated in the present case. It has further been submitted that the petitioner is still ready to keep the informant with full dignity and honour but the informant is not ready to live with the petitioner.

Heard learned A.P.P. also.

Having heard both sides. In view of the allegations levelled against the petitioner, I am not inclined to grant the

Patna High Court Cr.Misc. No.412 of 2017 (2) dt.16-01-2017 2/2 petitioner the privilege of bail. However as the petitioner is ready to keep the informant with full honour and dignity, let the petitioner surrenders before the Court below and Court below shall release the petitioner on provisional bail to his satisfaction and shall issue notice to the informant (wife) and try to make mediation between the parties and try to find out possibility of on event of the compromise between the parties and on being satisfied with the outcome, learned Court below shall pass an appropriate order, which he deems fit.

With the observation as above, this application is disposed of.
