09-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Ramgarh P.S. Case No. 251 of 2020, registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per the F.I.R., this petitioner, on the instigation of co-accused Bhushan Bind and Harilal Bind, assaulted the informant on his head with iron rod and thereby caused grievous injury.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to previous enmity. No such occurrence has taken place. In fact, the informant, in a drunken condition, was hurling abuses to the villagers, to which, the petitioner and others objected and in that course, the informant fell down on a breaker and sustained head injury.

Patna High Court CR. MISC. No.36991 of 2021(2) dt.09-12-2021 2/2 Petitioner is in custody since 07.03.2021. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Kaimur at Bhabua in connection with Ramgarh P.S.
