2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 302, 120(B), 34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

3. Petitioner along with other accused persons are said to have committed murder of the niece of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

5. Learned APP for the State opposing the prayer for bail submits that Sections 82 and 83 has been completed in

Patna High Court CR. MISC. No.28601 of 2023(5) dt.24-07-2023 2/2 this case.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Mahishi P.S. Case No. 335 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
