The petitioner seeks anticipatory bail in connection with Town P.S.Case No. 425 of 2012, registered for offences punishable under Sections 420, 468 of the Indian Penal Code. Allegation against the petitioner is that the petitioner is said to be an employee of OCPL Pvt. Ltd. Company and there is allegation that accused persons including the petitioner had taken the money from the informant and Sandesh Kumar on the assurance that bond paper and the original receipt of the payment will be given to them and thereafter closed the company and fled away.

Submission of the learned counsel for the petitioner

Patna High Court Cr.Misc. No.24805 of 2018 (2) dt.09-05-2018 2/3 is that there is no any specific allegation has been attributed against him and he is an employee of the company and other coaccused have been granted the privilege of anticipatory bail vide order dated 18.10.2016 passed in Cr. Misc. No. 42570 of 2016 and vide order dated 21.08.2013 passed in Cr. Misc. No. 14224/ 2013.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts that the other co-accused has been granted bail, let the petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- ( Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- II, Aurangabad in connection with Town P.S.Case No. 425 of 2012, subject to the condition that as laid down under Section 438 (2) of the Code of Criminal procedure.

With following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

iii) The petitioner shall co-operate in the investigation of the case and make himself available as and when required by the Police, otherwise, the prosecution is free to move for cancellation of his bail bond.
