JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-02-2017 The petitioner was, by an order dated 27.09.2016, allowed provisional bail during the pendency of present anticipatory bail application while issuing notice to the Bank. There is nothing on record to show that while on provisional bail the petitioner, in any manner misused the privilege of said bail.
Additionally, it has been submitted with reference to certain orders passed by this Court that other co-accused persons, namely, Subhash Kumar Modi, Sanjay Kumar Modi and Jyoti Kumari have been allowed anticipatory bail. The Branch Manager of the concerned Bank, who is said to have acted in conspiracy with this petitioner and others, has also been released on regular
Patna High Court Cr.Misc. No.40845 of 2016 (6) dt.15-02-2017 2/2 bail.
In view of the submissions as above, this application is allowed.
Let the petitioner, above-named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. Case No. 155 of 2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
