2. The present application has been filed for modification of the order dated 10.03.2026 passed in Cr. Misc. No. 12144 of 2026 by which the petitioner was granted bail in connection with Majorganj P.S. Case No. 463 of 2025, to the satisfaction of learned Special Judge NDPS, Sitamarhi.

3. Learned counsel for the petitioner submits that vide order dated 10.03.2026 passed in Cr. Misc. No. 12144 of 2026 the petitioner was granted bail with certain conditions and one of the conditions being that one bailor shall be deponent of the petition, namely, Md. Ishak who is the cousin of the petitioner. Learned counsel for the petitioner submits that the said condition be modified to the extent that in the place of bailor

Patna High Court CR. MISC. No.28594 of 2026(2) dt.01-05-2026 2/2 namely, Md. Ishak, Habib Miya Mansuri is ready to be the bailor of the petitioner. Learned counsel further submits that Habib Miya Mansuri, who is ready to be the bailor, is the cousin of the petitioner and is also the deponent of the present modification application.

4. Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the condition no. (I) as mentioned in paragraph no. 7 of the order dated 10.03.2026 passed in Cr. Misc. No. 12144 of 2026 is modified and is reproduced hereinbelow:

"(I) One of the bailors shall be cousin of the petitioner namely, Habib Miya Mansuri."

5. The rest of the conditions stipulated in the order will be same.

6. The order dated 10.03.2026 passed in Cr. Misc. No. 12144 of 2026 is modified to the extent as indicated above.

7. The modification application is, accordingly, allowed.
