JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 447, 379, 385, 504 and 307/34 of the Indian Penal Code. The prosecution case is that the petitioner long with other accused persons came at the door of the informant and abused him and on protest being made, co-accused Rahul Kumar pointed pistol on the temple of the informant and demanded extortion of Rs. 50,000/- and gave life threatening when the other accused persons assaulted the informant with fists and slaps and the petitioner took away Rs. 5000/- from the pocket of the informant and also put the rope around the neck of the informant. It is submitted by learned counsel for the petitioner that the injury on the neck has been found to be simple superficial in
Patna High Court Cr.Misc. No.56981 of 2015 (2) dt.17-12-2015 2/2 nature. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover Rahul Kumar and Kundan Kumar Pandey @ Pappu Kumar having specific accusation of assault have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 50198 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari in connection with Adapur P.S. Case No. 129 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
