The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 420, 411 of the Indian Penal Code, Section 3/4/5 of the Bihar Mines Act and Sections 33, 41 and 42 of the Indian Forest Act. The police seized stone chips on the truck of this petitioner.

Submission of the petitioner is that the truck is running on hire and the stone chips were being carried with valid permit vide Annexure-2 and valid challan vide Annexure-3. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days

Patna High Court Cr.Misc. No.53028 of 2016 (2) dt.21-12-2016 2/2 from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/Successor Court in connection with Barun Police Station Case No. 133 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
