The petitioner apprehends his arrest in Hajipur Town P.S. Case No.707 of 2017 registered under Sections 188, 379/34 of the Indian Penal Code and under B.M.M.C. Rule 1972, Rule 4, 40(1) (8) 49 of Bihar Minerals(Prevention of Illegal Mining Transportation Storage) Rule 2003.

The police officials seized different trucks loaded with sand and named the petitioner. The petitioner is of course the owner of two trucks bearing registration No.BR06-GC-3264 and BR06-GC3493. The trucks have already been released in favour of the petitioner. The petitioner was plying the trucks on hire and somebody hired the truck who were carrying the sand in the truck of the petitioner.

Patna High Court Cr.Misc. No.8506 of 2018 (2) dt.17-02-2018 Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-11-cum-Special Judge, Hajipur in connection with (Hajipur) Town P.S. Case No.707 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
