JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Buxar Mahila P.S. Case No.32 of 2017 registered under Sections 341, 323, 504, 506 and 498A/34 of the Indian Penal Code as well as Sections 3 and 4 of the Dowry Prohibition Act. It is submitted by the learned counsel for the petitioners that the petitioners are father-in-law and mother-in-law respectively. They neither demanded any dowry nor subjected the informant to cruelty at any point of time. He submitted that the petitioners' son had filed a matrimonial case for restitution of conjugal right on 02.08.2017 before the Family Court, Buxar and
Patna High Court Cr.Misc. No.5454 of 2018 (2) dt.02-02-2018 2/2 on the very next day the informant instituted the present FIR. Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Mahila P.S. Case No.32 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
