====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 07-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Goraul P. S. Case No.493 of 2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. The learned counsel for the petitioner submits that the petitioner is in custody since 16.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 412.920 litres of Indian made foreign liquor was recovered from a vehicle parked in a school.

The learned counsel for the petitioner submits that petitioner was not apprehended from the place of occurrence

Patna High Court CR. MISC. No.36675 of 2021(3) dt.07-12-2021 2/2 and it was the Chaukidar, who has alleged to have identified the petitioner as an accused, who fled away after seeing the police. Petitioner has no concern with the alleged liquor. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 16.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Goraul P. S. Case No.493 of 2020.

The application stands allowed.
