The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379 and 376/511/34 of the Indian Penal Code. It is alleged that the petitioner being the borther-in-law (Dewar) of the informant tried to establish physical relationship with the informant. The wife and mother of the petitioner used to assist him and they also used to fight with the informant.
It is submitted by learned counsel for the petitioner that due to the share dispute the accusation has been levelled and even assuming the accusation no offence under
Patna High Court Cr.Misc. No.56649 of 2015 (2) dt.14-12-2015 2/2 Section 376/511 of the IPC is made out.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 157 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
