JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Jamui P.S. Case No. 224 of 2015 for the offences instituted under Sections 147, 149, 341, 326 and 365 of the IPC. As per the prosecution case that the informant along with his wife and three sons were returning to his house from the court after taking bail in case No.1825C of 2014 and as soon as they reached near bus stand, all the accused persons surrounded them and assaulted them and thereafter fled away from tempo in the market.

Patna High Court Cr.Misc. No.57899 of 2015 (2) dt.09-03-2016 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case of abduction of the victim, namely, Zulfikar Alam. The said victim has been examined under Section 164 of the Cr.P.C. and has not named the petitioners.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Jamui P.S. Case No. 224 of 2015/G.R.No.1472 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
