The petitioner apprehends his arrest in Complaint case No. 1190 of 2014 under Section 467, 468, 471 and other Sections of the Indian Penal Code.

The complainant alleged that petitioner and other accused persons mortgaged her property in the bank and took loan. The learned counsel for the petitioner submits that the complainant is aunt of the petitioner. The petitioner mortgaged the joint family property in Mahendiya branch of Punjab National Bank but he has already paid the entire amount of Rs. 10 lac in the Punjab National Bank, Mahendiya branch. The petitioner also

Patna High Court Cr.Misc. No.48737 of 2016 (2) dt.16-12-2016 2/2 took loan from Punjab National Bank, Belkhara branch but the land mortgaged in the branch belongs to his father and grand father. The dispute is of civil nature as the land fell in the share of petitioner and his family.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in Complaint Case No. 1190 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
