Petitioners apprehend their arrest in connection with Sono P.S.Case No. 101 of 2017 registered for the offences punishable under Sections 147, 148, 149, 307, 325 and 302 of the Indian Penal Code.
Allegation against the petitioner No.2 is of firing at the deceased and allegation against petitioner No.1 is of assault by sword to the informant.
Submission of learned counsel for the petitioners is that post mortem report and injury report show that there is no injury of fire arm on the person of deceased and there is no sharp cutting injury on the informant and there is land dispute between the parties from before.
Patna High Court Cr.Misc. No.12975 of 2018 (2) dt.05-04-2018 2/2 Heard learned APP and learned counsel for the informant.
Having heard both sides and in view of specific accusation against both the petitioners, I am not inclined to grant them anticipatory bail. Let them surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
