The petitioner who is in custody since 12.08.2018 has filed the instant application for grant of bail in connection with Kothi P.S. Case No. 42 of 2018 (District Gaya) registered for the offence punishable under sections 8, 20(b) (ii)(c), 25 and 29 of the NDPS Act.

As per the allegation in the FIR 11.160 Kg doda is said to have been recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is in custody since 12.08.2018, he has no

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner is in custody since 12.08.2018, he has no criminal antecedent and similarly situated co-accused has been granted bail, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge, 2nd, Gaya in connection with Kothi P.S. Case No. 42 of 2018 (District Gaya).
