JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-11-2024 This writ application has been filed for following reliefs:- "(i) For issuance of writ in the nature of mandamus for commanding the Respondents to immediately appoint him on compassionate ground in lieu of his mother who died in harness.

(ii) For issuance of writ for commanding the Respondents to appoint the petitioner on compassionate ground as his father as well as his younger brother has declared on Oath that the petitioner is fully entitled to join in service in lieu of

(iii) For any other writ/writs, direction/ directions, order/orders, as this Hon'ble Court may deem fit and proper as the facts and circumstances of this case."

In this regard, a counter affidavit has been filed on behalf of State and in paragraph - 10, it has been stated that an index of application for Niyojan on the basis of compassionate ground has been prepared in descending order according to date of death and name of the petitioner is mentioned at Sl.No. 17. Photocopy of the index of application has been annexed as Annexure - 'C' to the counter affidavit.

3. In view of Annexure 'C' to the counter affidavit, learned counsel for the petitioner seeks permission to withdraw this writ petition.

4. Permission is granted.
