2. The present application has been filed for quashing of the order dated 21.07.2016 passed by learned Additional Sessions Judge-IV Bhagalpur in connection with S.T. No.288 of 2012 arising out of Pirpainti P.S. Case No.42 of 2011 by which he had framed charge under Section 436/34 of Indian Penal Code, rejecting the discharge petition under Sections 227 of the Cr.P.C.

3. It has been informed by the learned District Court vide Letter dated 09.07.2025 that the trial has already progressed and is at the stage of prosecution evidence in

Patna High Court CR. MISC. No.39355 of 2016(5) dt.16-09-2025 2/2 connection with Pirpainti P.S. Case No.42 of 2011.

4. In view of the changed stage of trial, the present quashing application stands consigned with liberty to the petitioners to avail appropriate remedy.
