JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in connection with Koilwar P.S. Case No. 149 of 2016 registered under sections 420, 406, 467, 468 and 471 of the Indian Penal Code. Allegation in brief is that these petitioners promised the complainant to give franchisee as they have got some tenders for preparation of Adhar Card.
It is alleged that the complainant entered into an agreement with one Baleshwar Raut and two cheques amounting to Rs. 4,50,000/- were given to co-accused Kaushal Kumar Gautam. It is submitted that there is no agreement with the
Patna High Court Cr.Misc. No.50341 of 2016 (3) dt.10-02-2017 petitioners rather the allegation is against Kaushal Kumar Gautam and the amount of two cheques have been credited in his account. Learned counsel for the petitioners submits that the petitioners are not party to the agreement and they have no criminal antecedent. Learned counsel for the complainant submits that these petitioners are indulged in cheating the innocent persons. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioners, namely, (1) Mukesh Kumar Paswan @ Mukesh Kumar; (2) Babu Lal Paswan @ Babara Kumar @! Babu Lal; and (3) Rajesh Kumar Paswan @ Kumar Rakesh be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhojpur, Ara in connection with Koilwar P.S. Case No. 149 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
