The petitioners are apprehending their arrest in a case registered under Sections366A/34 of the Indian Penal Code. Allegation is that the petitioners kidnapped the daughter of the informant with intent to marry her.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The victim has been examined under Section 164 Cr.P.C. She has denied the allegations made in the F.I.R. She has further stated that she has got married with the petitioner No.1 and

Patna High Court Cr.Misc. No.51169 of 2016 (2) dt.29-11-2016 she wants to reside with him.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IInd, Banka in connection with Balahar (Khesar) P.S. case No.87 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
