JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-12-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of S.C. 90/2016/821/17 arising out of Complaint Case No. 985C/2014, disclosing offences under Sections 3⁄4 of Dowry Prohibition Act.

Allegedly, petitioner no. 1 refused to marry the complainant's daughter as the complainant failed to satisfy the demand of dowry which was being made by the petitioner no. 2. Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.44141 of 2017 (3) dt.19-12-2017 2/2 summonses have been issued and they apprehended arrest if they appear before the court below in compliance of the said summons. Learned counsel for the complainant has opposed the prayer of anticipatory bail.

Considering the submission, as above, this application is allowed.

Let the petitioners, above named, in the event of their arrest of surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Bettiah, West Champaran, in connection with S.C. 90/2016/821/17 arising out of Complaint Case No. 985-C/2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
