====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-11-2020 Heard learned counsel for the petitioner and the State as well as informant.

The petitioner is in custody in connection with Bodhgaya P.S. Case No. 511 of 2019 for the offence under Section 396 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The case was registered against unknown. He further submits that the petitioner is in custody since 10.12.2019, but he was not put on T.I.P.

Considering the fact that petitioner, who is in custody since 10.12.2019, having no criminal antecedent, yet he has not

No.30600 of 2020(2) dt.24-11-2020 2/2 been put on T.I.P., the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of Sri Vijyant Singh, Judicial Magistrate, 1st Class, Gaya in connection with Bodhgaya P.S. Case No. 511 of 2019 subject to the conditions that the petitioner shall deposit Rs.1,00,000/- (One lakh) cash in the court below and the same shall be abide by the final outcome in the trial i.e. if the petitioner is acquitted the amount of Rs.1,00,000/- shall be refunded in favour of the petitioner, otherwise it shall be forfeited.
