The petitioner apprehends her arrest in connection with Dumra P.S. Case no. 61 of 2016, registered under Sections 476, 336 and 418 of the Indian Penal Code and Section 18(c), 27(b)(ii), 18A, 18B, 28 and 36AC of the Drugs and Cosmetic Act and Rule 64 of the Drugs and Cosmetic Rule.

The accusation is that the informant raided the shop of Krishna Kumar and seized medicines, which was being sold without any valid licence of running the medicine shop. Learned counsel for the petitioner submits that petitioner is the wife of Dr. Rajiv Kumar, who is said to run M/s. Asha Seva Sadan adjacent to the medical shop of Krishna Kumar, except that there is nothing against the petitioner to show her involvement in the

Patna High Court Cr.Misc. No.44354 of 2016 (2) dt.22-10-2016 2/2 present case. Moreover, husband of the petitioner Dr. Rajiv Kumar has already been granted Anticipatory Bail vide Criminal Miscellaneous No. 16840 of 2016, dated 05.07.2016.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 61 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
