The present application seeks modification in the order dated 07.10.2015 passed in Cr. Misc. No. 33203 of 2014 by which while granting anticipatory bail to the petitioner, he was directed to surrender before the court below within six weeks from the date of the order.

Learned counsel for the petitioner submits that due to the petitioner being out of State and having fallen ill, he could not comply with the stipulation of surrendering before the court below for grant of bail within the time fixed by the Court in order dated 07.10.2015 passed in Cr. Misc. No. 33203 of 2014. It is submitted that for the ends of justice, once the court has found merit in the case of the petitioner and granted indulgence, due to unavoidable circumstances

Patna High Court Cr.Misc. No.5039 of 2016 dt.24-02-2016 2/2 intervening, the petitioner may not be made to suffer. Learned A.P.P. for the State does not oppose. Having considered the facts and circumstances of the case and the submissions of the learned counsel for the parties, the order dated 07.10.2015 passed in Cr. Misc. No. 33203 of 2014 stands modified to the extent that the period indicated for the petitioner to surrender before the court below for being released on bail, stands extended to 31st March 2016. The rest of the terms and conditions of the said order shall remain unchanged.

The application stands disposed off in the aforementioned terms.
