JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Complaint Case No. 319 of 2013 registered under Sections 420,406,467,468,471,323and 504 of the Indian Penal Code. It is contended that the prosecution story is imaginary and concocted one. Though the date of occurrence is 10.09.2012, the complaint has been filed on 12.02.2013 and there is no reasonable explanation of the delay caused in filing the complaint.

Patna High Court Cr.Misc. No.648 of 2016 (2) dt.11-01-2016 Be that as it may, regard being had to the nature of the offence, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Complaint Case No. 319 of 2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
