The petitioner is apprehending his arrest in connection with Sonepur P.S.Case No.898/18 , registered for offences punishable under Sections 504, 323, 341, 506, 316/34 of the Indian Penal Code.

Prosecution allegation as per the complaint petition is that the petitioner and other accused persons came variously armed caught hold the daughter-in-law of the complainant and the petitioner assaulted his daughter-in-law. It further appears that she was taken to the hospital where she gave birth to a dead child.

Submission of the learned counsel for the petitioner is that there is land dispute between the parties and earlier to filing of this case a complaint case had been filed by the petitioner stating that the informant and others have tried to

No.26011 o2019f 2019(3) dt.04-07-2019 2/2 grab the land and also assaulted and snatched money and due to that they have falsely been implicated in this case and no injury was found on the person of the daughter -in-law of the complainant though the dead child was delivered. Heard learned A.P.P. and the learned counsel for the complainant. They have opposed the prayer for bail. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Saran at Chapra in connection with Sonpur P.S.Case No.989 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
