1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Goraul Police Station Case No. 136 of 2024, disclosing offences under Sections 363, 366A, 34 of the Indian Penal Code.

3. As per the FIR, on 17.03.2024, in the morning, while the informant was sleeping with her children, petitioner along with other accused persons entered into her house, kidnapped her daughter, aged about 16 years, and fled away.

4. Learned counsel for the petitioner submits that the petitioner has committed no offence in the manner alleged,

No.32638 of 2025(5) dt.18-12-2025 2/3 and she has falsely been implicated in this case only due to the fact that petitioner is the mother of co-accused Raj Kumar Ram with whom the informant's daughter has eloped. Learned counsel next submits that during course of investigation, it has come to light that Raj Kumar Ram was working in the house of the informant and both of them i.e., Raj Kumar Ram and the victim girl fled away. In paragraph 76 of the case diary, the statement of the informant has been recorded in which she has stated that her daughter was kidnapped by co-accused Raj Kumar Ram.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that during course of investigation, it has come that Raj Kumar Ram was working in the house of the informant and both Raj Kumar Ram and the victim girl are traceless and petitioner is mother of the co-accused Rajkumar Ram, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount

No.32638 of 2025(5) dt.18-12-2025 3/3 each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Vaishali at Hajipur, in connection with Goraul Police Station Case No. 136 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
