JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2023 The matter has been listed under the heading "To Be Mentioned", at the instance of learned counsel for the petitioner by filing a mentioning slip (Flag 'X').

2. It is submitted by learned counsel for the petitioner that due to inadvertence, in first paragraph of aforesaid order dated 08.09.2023, instead of restoration of "Cr. Misc. No. 65698 of 2022", it was wrongly typed as Cr.Misc. No. 54802 of 2023. Similarly, in the second paragraph, aforesaid Cr.Misc.Case (i.e. Cr.Misc. No. 54802 of 2023) was directed to be restored to its original file. Accordingly, it has been prayed to correct the same.

3. In view of aforesaid fact, the order dated 08.09.2023 is corrected and following order be read in place of earlier order:

Patna High Court CR. MISC. No.54802 of 2023(3) dt.01-12-2023 2/2 "This petition has been filed for restoration of Cr.Misc.No. 65698 of 2022, which stood dismissed due to non prosecution, vide order dated 21.03.2023.

2. Reasons given in the restoration petition are accepted and Cr.Misc. No. 65698 of 2022 is restored to its original file.

3. Restoration petition is thus allowed."
