The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 504 of the Indian Penal Code.

It is alleged that petitioner no. 1 Ravi Patel assaulted with sword on the leg of the informant, petitioner no. 3 Nirbhay Patel inflicted injury with farsha and sword to the informant on his head. When he fell down, other accused persons assaulted the informant. When the brother of the informant came to rescue, then he was being assaulted by co-accused Rajendra Patel and

Patna High Court Cr.Misc. No.57911 of 2015 (2) dt.04-01-2016 Arun Patel.

It is submitted by the learned counsel for the petitioners that the injury report of the informant suggests of lacerated wound, caused by hard and blunt substance. Petitioner no. 1 and 3 assaulted with sharp cutting weapon. There is no specific accusation of assault by petitioner no. 2. Considering the accusation not being corroborated by medical opinion and the fact that there is counter version of the occurrence, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (T) P.S. Case No. 618 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
