The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147, 148, 149, 323, 324, 307, 504, 506 and 379 of the Indian Penal Code. The prosecution case is that the informant being a labour after unloading the sand from the truck was going to his village when he was surrounded by the accused persons, who assaulted him with 'dabiya'

and snatched Rs.500/-.

Subsequently, the informant identified five persons named in the FIR including the petitioners.

It is submitted by learned counsel for the petitioners that for the occurrence of 18.09.2015 at 7 pm, the 'fardbeyan' was recorded on 19.09.2015 at 02.30 pm. which came to be registered

Patna High Court Cr.Misc. No.58007 of 2015 (2) dt.04-01-2016 2/2 as police case on 25.09.2015 at 09.00 pm. Accusation is not specific as to who actually assaulted the informant. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Sadar (Muffasil) P.S. Case No.386/2015, pending before the learned CJM, Purnea. With the above observation, this application is, accordingly, disposed off.
