The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 341, 323, 504, 506 of the Indian Penal Code and Section 138 of N.I.Act. As per the prosecution case, informant gave Rs. 8,00,000/- to this petitioner to provide job to his son, but the petitioner failed to do so and refused to return the money. It is submitted on behalf of petitioner that in fact, said money was given to co-accused Jitendra Kumar Mishra, who is friend of this petitioner, and not a single penny was paid to this petitioner. Petitioner has got no concern with the alleged occurrence and he has got clean antecedent.

Learned A.P.P. for the State and learned counsel for informant opposed the prayer for anticipatory bail.

No.27261 of 2022(2) dt.22-09-2022 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Manihari P.S. Case No. 32 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
