JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case filed with accusation for the offences punishable under Sections 323, 447, 465, 467 and 504 of the Indian Penal Code, wherein, process has been directed to be issued after cognizance being taken.
The prosecution case is that the complainant's land was sold and three sale deeds were registered by one Raj Kumar Bajaj. It is alleged that the petitioner was the witness of two sale deeds.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.334 of 2016 (2) dt.07-01-2016 thrust of accusation is against one Raj Kumar Bajaj. A statement has been made in paragraph no. 3 that the petitioner has got no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Purnea in connection with Complaint Case No.2769 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
