Mr. Ram Prawesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-04-2019 Heard learned counsel for the parties.

This application for anticipatory bail arises out of Thakurganj Police Station Case No. 169 of 2018, disclosing offences punishable under Sections 147, 148, 149, 323, 324, 307, 428, 504, 506 and 379 of the Indian Penal Code. From the First Information Report, it can be noticed that the quarrel between the parties took place as some of the hens belonging to the informant were found to be dead. There is allegation of assault made by lathi and sickle. Learned counsel, appearing on behalf of the petitioners, has submitted that no injury has been found to be grievous in nature.

Patna High Court CR. MISC. No.27497 of 2019(2) dt.26-04-2019 2/2 Considering the fact that the petitioners have criminal antecedent, as disclosed in paragraph 3 of the application, I am not inclined to grant them the privilege of anticipatory bail. This application is, accordingly, dismissed.

The petitioners are directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If they do so, their application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
