JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Singhia P.S. Case No. 146 of 2016, registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 354, 504 and 506 of the Indian Penal Code.
The accusation is that twelve persons named in the F.I.R. including the petitioners armed with weapons came in the filed of the informant and started to plough his field by tractor. When the informant along with his family members made protest then petitioner no. 1 gave Farsa blow at his head. At that time, co-
accused Raj Kumar Singh, gave Farsa blow at the head of brother of the informant whereas petitioner no. 6 also caused injury at the hand and leg of the brother of the informant. Petitioner no. 2 caused injury at Birju Singh through iron road and petitioner no. 3 caused injury at the head Mohan Singh through axe whereas coaccused, Laxman Singh also caused injury at the head Shashi Devi, wife of the informant. Thereafter, Prabhat Kumar Singh and Sandeep Kumar snatched the gold chain and ear ring from his daughter and also caused injury at her head through iron rod. Thereafter, petitioner nos. 4 and 5 also caused injury at his daughter.
Learned counsel for the petitioners submits that occurrence took place due to land dispute, in which, petitioners' side also sustained injury, regarding which, Signhia P.S. Case No. 145 of 2016 is also instituted on 09.11.2016. Moreover, the injuries as found on the persons of his brother, wife and daughter are simple in nature.
Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the
satisfaction of the Additional Chief Judicial Magistrate-V, Rosera, Samastipur, in connection with Singhia P.S. Case No. 146 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
