JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 Petitioners seek bail in anticipation of their arrest in connection with Balia P.S. Case No. 208 of 2018 registered for the offences punishable under Sections 447, 341, 323, 504, 384, 323, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that petitioners came and demanded extortion of Rs.60,000/- from the informant for cultivating the field and thereafter petitioner No.1 assaulted him by butt portion of rifle and petitioner No.2 shot fire at him which hit on his leg.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and the

No.27525 of 2019(4) dt.09-07-2019 2/2 case lodged by the petitioners is earlier to the present case and in counter case petitioner No.1 has received four injuries, including firearm injury on chest. Further submission is that all the injuries are simple in nature except one which is said to be grievous in nature on head and no firearm injury was found. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Balia P.S. Case No. 208 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
