2. This appeal has been filed against the order dated 26.09.2024 passed by learned ADJ 1st cum Special Judge, SC/ST Act, Siwan in connection with Andar P.S. Case No. 5 of 2024, registered under Sections 302/34 of the Indian Penal Code and Sections 3(1)(r)(s), 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (for short "SC/ST Act"), whereby the prayer for bail of appellant has been rejected.

3. As per F.I.R., on the alleged date and time of occurrence, this appellant along with other co-accused persons

Patna High Court CR. APP (SJ) No.1575 of 2025(5) dt.25-11-2025 2/2 brutally assaulted son of informant with iron rod and danda, due to which, son of informant died. The accused persons also abused informant's son with caste name.

4. The appellant is one of the assailant of the deceased. The post-mortem report supports the prosecution case. Doctor has found several external injuries on the body of the deceased by hard & blunt substance.

5. Considering the nature of accusation, the appeal filed for grant of bail stands dismissed. However, since the appellant is in custody since 31.03.2024, the learned trial court is directed to expedite the trial.
