====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Ballia P.S. Case No. 56 of 2019, instituted for the offence under Section(s) 30(a), 37(i), 38(i) and 41(i) of Bihar Prohibition Excise Act, 2016. Counsel for the petitioner submits that petitioner has clean antecedent. There is no recovery from conscious possession of the petitioner.

It is alleged in the written report that 90 litres of foreign liquor and 33.48 litres of country made liquor has been recovered from house of the petitioner. Petitioner has been made accused merely on suspicion. He further submits that other co-accused have already been granted bail by coordinate Bench of this Court vide order dated 24.4.2019 passed in Cr.

Patna High Court CR. MISC. No.27726 of 2019(2) dt.29-04-2019 2/2 Misc. 26866 of 2019.

Petitioner is in custody since 2.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Excise Act, Begusarai, in connection with Ballia P.S. Case No. 56 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
