Petitioners are apprehending arrest in connection with Dhoraiya P.S.Case No.218 of 2019 for the offence under Sections 341, 323, 307 and 447/34 of the Indian Penal Code. Learned counsel for the petitioners would submit that petitioner no.1 is 70 years old whereas petitioner no.2 is grandson aged about 19 years. On account of land dispute, the dispute arose between the petitioners and the informant, who are agnates and they have entered into scuffle. It is alleged that petitioner no.2 is only member of the mob.

Considering the fact that there is no allegation of

No.27623 of 2020(2) dt.25-11-2020 2/2 overt-act against the petitioner no.2 and also considering the age of petitioner no.1 who is 70 years old, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners named above, be released on bail in the event of arrest or surrender before the court below within a period of one month from the date of communication of a copy of this order, on furnishing bail bond of Rs.50,000/- (fifty thousand)each with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Dhoraiya P.S.Case No.218 of 2019, subject to the condition as laid down under section 438(2) of the Cr.P.C.
