JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sugauli P.S. Case No. 423 of 2017 for the offenses under Sections 414, 420, 467, 468, 469, 471 of the Indian Penal Code. It is alleged that petitioner has purchased a vehicle on 6.10.2017 from one Ram Niwas Dubey for a consideration of Rs. 4,50,000/-and thereafter he sold the vehicle to one Md. Israil on 7.12.2017.

Learned counsel for the petitioner submits that the case is triable by the Magistrate and the petitioner is in custody since 23.02.2019.

Considering the fact that case is triable by Magistrate,

Patna High Court CR. MISC. No.26689 of 2019(2) dt.24-04-2019 2/2 let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S. Case No. 423 of 2017.

While directing release of the petitioner, the Court below is directed to expedite the trial and conclude the same within a maximum period of six months from today. (Anil Kumar Upadhyay, J) spandey/- U T
