The petitioner is apprehending his arrest in connection with Sheikhpura (Hathiyama) P.S.Case No. 04 of 2011 registered for the offence under Sections 341, 323, 307, 379/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of snatching gold rink and watch from the informant.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and further submission is that co-accused having similar allegation has already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc.No.36883 of 2017, vide order dated 10.8.2017. Heard learned APP also.

No.36680 of 2017 (2) dt.11-08-2017 2/2 Having heard both sides and in view of the facts and circumstances and similarly situated co-accused has been granted privilege of anticipatory bail, let petitioner, above named, surrender within a period of four weeks before the court below and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Sheikhpura, in connection with Sheikhpura (Hathiyama) P.S.Case No. 04 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors should be a local person having sufficient properties within the jurisdiction of court concerned and he will co-operate in investigation of the case and make himself available before the investigating officer as and when required, failing which his bail bond shall be cancelled.
