JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Motihari Town P.S. Case No. 473 of 2016 registered under Sections 409 and 420 of the Indian Penal Code. The accusation is that petitioner being the technician in the B.S.N.L. posted as Motihari, collected Rs. 4,58,446/- from the different franchises but the said amount was not deposited in the account of B.S.N.L., Motihari. Learned counsel appearing on behalf of the petitioner submits that petitioner was a Regular Mazdoor in the B.S.N.L. Department and cash Rs. 4,58,446/- was collected by the permanent employee of B.S.N.L. Department, but only to save the

Patna High Court Cr.Misc. No.44226 of 2016 (2) dt.24-10-2016 2/2 permanent employee, this petitioner has been made accused in the present case. Further submission is that Rs. 4,58,466/- has already been deposited in the name of petitioner.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Motihari, East Champaran in connection with Motihari Town P.S. Case No. 473 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
