The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 436 and 34 of the Indian Penal Code.

It is submitted on behalf of the petitioners that there is general and omnibus allegation against the petitioners. He further submits that there is land dispute in between the parties. He further submits that informant and petitioner no.1 are full sisters and they are daughters of one Chandradeo Rai, who gifted some self acquired property to the petitioners, which caused annoyance to the informant. It is also submitted that

Patna High Court CR. MISC. No.26893 of 2019(3) dt.17-07-2019 2/2 partition suit is going on in between the parties bearing Partition Suit No.833 of 2014.

Considering the facts aforesaid, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge-III (West)- cum-Additional Chief Judicial Magistrate, Muzaffarpur/successor Court in connection with Kudhani P.S.Case No.589 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
