The present appeal is directed against order dated 22.05.2020 passed by Special Judge, SC/ST Act, Samastipur in connection with Hasanpur PS Case No. 270/2019 for the offence registered under Sections 147, 307, 323, 325, 341, 379, 477, 448, 504, 506 IPC and Section 3(1) (r) (s) /, 3(2) (va) of the SC/ST Act, by which bail application of the appellant has been rejected.

3. The allegation as per First Information Report is that appellant along with other accused persons assaulted the informant and his family members and there is specific allegation against the appellant that he assaulted the informant by means of Lathi on his left leg.

4. Learned counsel for the appellant submits that appellant has been implicated in this case due to village politics and

Learned counsel further submits that the appellant is in custody since 07.05.2020 and a co-accused, namely, Sohit Singh @ Sohit Amarjeet Singh has been granted bail by this Court vide Cr. Appeal (SJ) No. 1054/2020 (Annexure-2).

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that appellant is in custody since 07.05.2020 and the appellant has allegedly assaulted on the non vital part of the body, I am inclined to grant regular bail to the petitioner, setting aside the order of learned court below dated 22.05.2020.

6. Accordingly, let the petitioner, ROHIT SINGH @ ROHIT KUMAR SINGH be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, SC/ST Act, Samastipur in connection with Hasanpur PS Case No. 270/2019.
