The petitioner has preferred this application for grant of regular bail in a case registered under section 308 and other sections of the Indian Penal Code.
As per the prosecution case, the petitioner and others are stated to have come variously armed forming an unlawful assembly and on the orders of the petitioner, the accused persons assaulted the informant and others. It is further stated that the petitioner assaulted one Md. Khalik on his head. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From the injury report of Md. Khalik, it would transpire that the injury has been found to be simple in nature. The petitioner is in
Patna High Court CR. MISC. No.36938 of 2021(3) dt.03-02-2022 2/2 custody since 12.3.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 10 months together with the injury having been found to be simple in nature, the Court directs the petitioner to be enlarged on bail in connection with Amour P.S. Case no.37 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea.
