JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-11-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 420 of the Indian Penal Code and sections 103 ande104 of Trade Mark Act and sections 63, 64 and 65 of the Copy Right Act.
Prosecution case is that fake pesticide was recovered from the house of the petitioner.
Learned counsel for the petitioner denies the allegation and submits that the petitioner is innocent and has falsely been implicated in this case. Alleged pesticide was kept for personal use and petitioner was unaware that the same was fake. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender
Patna High Court CR. MISC. No.27391 of 2022(2) dt.14-11-2022 2/2 within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in Chausa Police Station Case No. 47 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
