Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 02-08-2019 The petitioners apprehend their arrest in connection with Rajoun P. S. Case No. 49 of 2019 registered under Sections 201 and 306/34 of the Indian Penal Code.

Allegation against the petitioners, as per the FIR lodged by SHO, Rajoun Police Station, is that on 23.03.2019, a news was published in the newspaper regarding death of one Saurabh Santosh due to electric shock. Accordingly, informant went to the house of deceased in order to investigate the fact where all family members mentioned the cause of death as to be electrocution but they failed to give satisfactory answer regarding the place of occurrence i.e., place where the deceased was electrocuted.

Learned counsel appearing on behalf of the petitioners

Patna High Court CR. MISC. No.24982 of 2019(6) dt.02-08-2019 2/2 submits that petitioner no. 1 is wife and petitioner no. 2 is father of the deceased and both have been implicated by the police on mere suspicion. He submits that deceased has died due to electrocution accidentally and no suicide was committed by the deceased.

After having heard learned counsel for the parties and taking into consideration the fact that deceased has died due to electrocution and petitioners are wife and father of the deceased, as such I am inclined to grant anticipatory bail to the petitioners. Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Rajoun P.S.Case No. 49 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
